GENERAL CONDITIONS OF SALE, BOOKING AND MEMBERSHIP
Flamingo Surf Club Puglia
1. Introduction and scope of application
These general conditions govern, within the limits in which they are applicable, the request, booking, and purchase of lessons, courses, packages, sports activities, related services, and membership procedures offered by ASD Flamingo Surf Club Puglia through the website www.flamingosurfclub.it, by telephone contact, email, WhatsApp, social networks, presence at the venue, or other channels made available by the Club.
The document is built taking into account the current structure of the site, which mainly allows users to request information, request membership, and book lessons, without a complete online payment system necessarily being active. These conditions are therefore suitable both for the current model of contact and manual confirmation and for any future online booking or payment system, provided that the technical flow is configured consistently with what is set out here.
“Club” means ASD Flamingo Surf Club Puglia, tax code and VAT number 08615610725, with its registered office or place of activity at Contrada Paludi, 76125 Trani (BT). “Customer” or “User” means the person who requests information, books, purchases, participates in the activities, or completes membership, directly or, in the case of minors, through the person exercising parental responsibility or having legal representation.
2. Subject of the services
The Club carries out sports and training activities connected to the world of the board, the sea, and training, including, by way of example, surf, skate, windsurf, SUP, and training lessons and courses. The activities may be organized in the form of a single lesson, course, lesson package, training session, group session, individual activity, event, sports experience, beginner program, or advanced course, as communicated from time to time to the Customer.
The essential characteristics of the service, the price, the duration, the place of performance, the calendar, the required level, any minimum or maximum number of participants, the presence of instructors, the equipment included, the conditions of participation, and any other relevant information are communicated to the Customer before confirmation of the booking or purchase. In the event of a discrepancy between generic information published on the site and specific conditions communicated for a given activity, the latter shall prevail, provided they are made available to the Customer before the conclusion of the contract.
The sports activities offered by the Club take place, in part, in natural environments or in any case conditioned by external elements. The actual performance of the lessons and courses may therefore depend on weather conditions, sea state, wind, area safety, facility availability, authority requirements, instructor assessment, and other circumstances not entirely foreseeable at the time of booking.
3. Request for information, booking, and conclusion of the contract
Filling out a form on the site, sending a message, requesting membership, or expressing interest in a lesson does not automatically entail the conclusion of the contract, nor does it bind the Club to provide the requested service. Such communications represent a preliminary request, which the Club may follow up on by verifying availability, requirements, calendar, and operating conditions.
The contract is considered concluded only when the Club expressly confirms the booking or purchase by email, written message, receipt, payment confirmation, acceptance at the venue, or other means suitable to document the agreement. Confirmation may be subject to full or partial payment of the price, completion of membership, delivery of required documentation, acceptance of the regulations, and verification of the user’s fitness for the specific activity.
Should an online payment system be activated, the Customer must be able to review these conditions, the privacy policy, and the essential information about the service before making the payment. The final button or command must make it clear that the operation entails an obligation to pay, as required by the legislation on distance contracts.
4. Prices, payments, and tax documentation
The prices of lessons, courses, packages, activities, and any membership fees are those indicated at the time of confirmation or communicated directly by the Club. Unless otherwise indicated, prices are in euros and include the applicable taxes within the limits provided for by the Club’s tax regime and current legislation.
Payment can be made using the methods made available by the Club, such as payment at the venue, bank transfer, electronic instruments, payment links, online platforms, or other agreed means. The booking may be subject to advance payment of the full amount or a deposit. In the event of non-payment within the indicated terms, the Club may not confirm the booking or may reassign the slot to other users.
Tax or accounting documentation will be issued according to the applicable legislation and the nature of the operation, distinguishing, where necessary, between membership fees, memberships, specific charges, sports services, commercial activities, or other amounts due. The Customer is required to promptly communicate any data necessary for the issuance of an invoice or other tax document before the document itself is issued.
5. Membership and the associative relationship
Where participation in the activities requires membership or admission to the association, the relevant request will be handled according to the statute, internal regulations, resolutions of the associative bodies, and any rules of the sports promotion body, federation, or reference organization. The membership request does not automatically entail admission, as verification by the Club or the competent bodies may be necessary.
Membership, once completed, grants the member the rights and obligations provided for by the applicable associative discipline. Any membership or affiliation fees do not necessarily represent the consideration for a single lesson or service, but may be functional to participation in the associative life, insurance coverage, inclusion in internal registers, affiliation, or other purposes connected to the nature of the Club.
The Customer acknowledges that the discipline of membership may be distinct from the discipline of the sale of sports services. Where fees, charges, or payments are of a different nature, the Club may indicate their amount, reason, and conditions separately, also for tax and insurance purposes.
6. Participation requirements, minors, and physical fitness
Participation in the sports activities presupposes that the Customer is in physical condition compatible with the chosen activity and that there are no pathologies, limitations, impediments, or personal circumstances such as to make sports practice dangerous. The Club may request, where provided for or deemed appropriate, the presentation of a medical certificate, fitness declarations, information on the technical level, or other documents necessary to assess safe participation.
In the case of minors, the booking, membership, and participation must be made or authorized by a parent, guardian, or entitled party. The Club may request the signing of specific forms and reserves the right not to admit the minor to the lesson should the required authorization be missing or the organizational and safety conditions not be met.
The Customer undertakes to follow the instructions of the instructors, the Club’s regulations, the safety indications, and the rules of conduct in the water, on the beach, in the skate area, in the gym, or in any other place where the activity takes place. Failure to comply with the instructions may result in the interruption of the lesson, removal from the activity, or suspension of participation, without the right to a refund where the Customer’s conduct has compromised their own safety or that of others.
7. Equipment, use of materials, and liability for damage
When the service includes the use of Club equipment, such as boards, wetsuits, sails, paddles, protective gear, skateboards, or other materials, the Customer is required to use them with care, according to the instructions received and within the limits of the authorized activity. The equipment must be returned in the condition in which it was delivered, except for normal deterioration resulting from correct use.
The Customer is liable for damage caused by wilful misconduct, gross negligence, improper use, failure to comply with the instructions, or negligent conduct. It remains understood that sports activities may involve physiological wear of the materials and ordinary risks connected to the practice, which will be assessed case by case based on the actual circumstances.
The Club is not liable for the loss, theft, or damage of the Customer’s personal belongings left unattended in common areas, beaches, vehicles, changing rooms, meeting points, or places where the activities take place, except in the case of liability of the Club ascertained according to law.
8. Changes, postponements, and cancellations for safety reasons or force majeure
The Customer acknowledges that lessons and activities, especially those carried out at sea or outdoors, may be postponed, modified, or cancelled for reasons of weather, sea, wind, safety, area unavailability, measures of the authorities, instructor impediments, emergencies, breakdowns, force majeure, or other circumstances not attributable to the Club.
In such cases, the Club will propose, where possible, a new date, a make-up session, an alternative solution, or a credit usable for another equivalent activity. A postponement ordered for safety reasons does not constitute a breach by the Club, as the protection of the participants’ safety prevails over the performance of the activity on the originally scheduled date.
Should the activity not be able to be made up within a reasonable time for a reason attributable to the Club, the Customer will be entitled to a refund of the amount paid for the service not used, unless they prefer to accept a voucher, a rescheduling, or another agreed solution.
9. Withdrawal, cancellation, and Customer no-show
A Customer who is unable to take part in a lesson or activity already confirmed must communicate this promptly to the Club. Unless otherwise indicated at the time of booking, a request for rescheduling or cancellation communicated at least twenty-four hours in advance may allow, compatibly with organizational availability, the rescheduling of the lesson at no additional cost.
A cancellation communicated beyond that term or a no-show at the agreed place and time may result in the loss of the amount paid or of the booked lesson, when the Club has already reserved instructors, materials, time slots, or places that can no longer be reassigned. The Club retains the possibility to assess, in good faith, documented cases of illness, serious impediment, or other exceptional circumstances.
Lesson packages must be used within the term possibly indicated at the time of purchase. In the absence of a specific term, the Club may indicate a reasonable period of use depending on the sports season, the availability of instructors, and the nature of the activity.
10. Right of withdrawal in distance contracts
When the contract is concluded at a distance with a Customer who qualifies as a consumer, the discipline of the Consumer Code on the right of withdrawal applies, within the limits and with the exceptions provided for by law. In general, the consumer has a period of fourteen days to withdraw from the contract without giving reasons, unless one of the exclusions provided for by the applicable legislation applies.
The Customer acknowledges that the right of withdrawal may be excluded for services concerning leisure activities when the contract provides for a specific date or period of performance. Therefore, for lessons, courses, sessions, events, or sports activities booked for a specific date or period, the right of withdrawal does not apply in the cases provided for by law, without prejudice to the different postponement or cancellation discipline indicated in these conditions.
For services not referring to a specific date or period, the consumer may exercise the withdrawal within fourteen days of the conclusion of the contract, by sending an explicit declaration to the Club’s email address. If the consumer expressly requests that the service begin during the withdrawal period, they may be required to pay an amount proportional to the service already performed up to the moment they communicate the withdrawal. If the service has been fully performed with the express consent of the consumer and with the acceptance of the loss of the right of withdrawal, the withdrawal can no longer be exercised within the limits permitted by law.
The withdrawal may be communicated by any explicit declaration, provided it is sent before the expiry of the term. For the sake of clarity, the Customer may use the following text: “I hereby communicate the withdrawal from the contract relating to the service purchased from ASD Flamingo Surf Club Puglia, indicating first name, last name, contact details, date of purchase or booking, service purchased and, if available, the order or confirmation reference.” The Club will confirm receipt of the request and will proceed with any refund due according to the methods and terms provided for by the Consumer Code.
11. Liability, sports risk, and insurance coverage
The Club organizes the activities with the diligence required by the sports and training nature of the service, making use of instructors and procedures consistent with the disciplines offered. However, it remains understood that surf, skate, windsurf, SUP, and training are physical activities that may involve ordinary risks of falling, impact, slipping, contact with equipment, fatigue, exposure to atmospheric agents, interaction with water, wind, waves, surfaces, and other participants.
The Customer takes part in the activities aware of their sports nature and undertakes to promptly communicate personal, physical, or health conditions relevant to safety. The Club is not liable for damage arising from inaccurate or omitted declarations by the Customer, from imprudent conduct, from failure to comply with the instructions, from improper use of the equipment, or from unforeseeable events not attributable to the Club.
Any insurance coverage connected to membership, affiliation, or participation in the activities operates within the limits, with the deductibles, exclusions, and conditions provided for by the respective policies. The Customer may request information on the applicable coverage before participating.
12. Communications, complaints, and assistance
For requests, clarifications, complaints, or communications relating to bookings, payments, services, or membership, the Customer can contact the Club at the contact details published on the site. The Club undertakes to handle communications in good faith and to provide a response within a reasonable time, taking into account the nature of the request and the organizational needs of the association.
The complaint should contain the Customer’s data, the service concerned, the date of the lesson or purchase, a clear description of the facts, and any useful documentation. The submission of a complaint does not automatically suspend payment obligations already accrued, unless otherwise agreed or otherwise provided by law.
13. Dispute resolution, applicable law, and jurisdiction
These conditions are governed by Italian law. In the event of a dispute, the parties undertake first to seek an amicable solution, including through the exchange of written communications and direct discussion.
Should the Customer qualify as a consumer, the mandatory jurisdiction of the court of the consumer’s place of residence or domicile, if located within the territory of the State, remains. In other cases, unless otherwise mandatorily provided by law, the court identified according to the ordinary rules of jurisdiction will have jurisdiction.
The Club does not declare, with these conditions, that it mandatorily adheres to specific alternative dispute resolution bodies, except as possibly provided for by mandatory rules or by subsequent communication. The European online dispute resolution platform, previously available for online consumer disputes, has been decommissioned as of 20 July 2025; therefore, the texts published on the site should not contain links to that platform as a still-operational channel.
14. Changes to the conditions and specific acceptance
The Club may modify these conditions to adapt them to regulatory, tax, organizational, technical, or commercial changes. The changes will apply to bookings and purchases made after their publication or communication, unless otherwise agreed between the parties or otherwise provided by law.
Before the conclusion of the contract, the Customer must be able to read and accept these conditions. Pursuant to and for the purposes of Articles 1341 and 1342 of the Italian Civil Code, where applicable, the Customer specifically acknowledges the clauses relating to the conclusion of the contract, advance payment, membership, participation requirements, liability for data and declarations, use of equipment, postponements for weather or safety reasons, late cancellation, no-show, exclusions and limits of the right of withdrawal, sports risk, limitations of liability, applicable law, and jurisdiction.
