The site is operated by ASD Flamingo Surf Club Puglia, with its registered office or place of activity at Contrada Paludi, 76125 Trani (BT), tax code and VAT number 08615610725. For information requests, the user can use the contact details published on the site, and in particular the phone number +39 350 5712397 and the email address info@flamingosurfclub.it, subject to subsequent updates of those contact details.

Should the identification data, registered office, contact details, or name of the operator change, the Club will update these terms and the relevant sections of the site, it being understood that the user is invited to always check the information published at the time of browsing or sending a request.

3. Nature of the site and value of the published information

The site has primarily informational and promotional purposes. It presents the history, activities, sports disciplines, services, initiatives, and contact channels of the Flamingo Surf Club, allowing the user to request information, express interest in membership, send collaboration requests, or book a lesson.

The information on the site is drafted with the utmost care, but does not constitute, unless otherwise expressly indicated, a binding offer to the public pursuant to Article 1336 of the Italian Civil Code, nor does it automatically entail the conclusion of a sales, booking, or membership contract. Every request sent via form, phone, email, social network, WhatsApp, or other channels must be confirmed by the Club, which may verify availability, operating conditions, user requirements, calendar, weather and sea conditions, and any other element relevant to carrying out the activity safely.

The images, descriptions, texts, and representations of the activities are for illustrative purposes. The actual organization of lessons, courses, and sports initiatives may depend on external factors, such as weather conditions, sea state, instructor availability, student level, number of participants, safety requirements, provisions of the competent authorities, or applicable regulations.

4. Access to the site and user obligations

Access to the site is free, except for any reserved areas or features that the Club may introduce in the future. The user undertakes to use the site correctly, lawfully, and in accordance with its purpose, avoiding any conduct that may damage, compromise, overload, or interfere with the functioning of the site, servers, IT systems, or networks used by the Club or by third parties.

When filling out a contact form, a membership request, a booking request, or any other form on the site, the user undertakes to provide truthful, up-to-date, and relevant data, avoiding the sending of unlawful, offensive, defamatory, discriminatory content, content contrary to public decency, or content harmful to the rights of third parties. The Club may not follow up on requests that are incomplete, manifestly abusive, irrelevant, originating from fictitious identities, or otherwise incompatible with its activities.

The user is responsible for the information entered in the forms and for the consequences arising from any inaccuracy of the data provided. Where a request concerns a minor, the communication must be made by the person exercising parental responsibility or by a party entitled to act in the interest of the minor.

5. Membership, bookings, and contractual relationships

The membership request and booking features on the site are intended to allow an initial contact with the Club. Sending a request does not automatically entail admission as a member, the completion of membership, the confirmation of a lesson, or the conclusion of a contract. Such relationships are governed by the sales and booking conditions, by the association’s statute or regulations, by any federal rules or those of the relevant sports promotion body, as well as by the specific conditions communicated to the user before confirmation.

The Club reserves the right to verify the compatibility of the request with its own organizational availability and with the safety conditions of the sports activity. In particular, any participation in lessons, courses, or sports activities may be subject to verification of age, technical level, physical fitness, the presence of parental or guardian authorization in the case of minors, as well as the acceptance of regulations, information waivers, or declarations required to carry out the activity.

6. Intellectual property and site content

All site content, including texts, images, photographs, graphics, logos, trademarks, distinctive signs, videos, layout, page structure, graphic elements, and descriptive materials, is protected by the applicable legislation on copyright, trademarks, distinctive signs, and unfair competition, unless otherwise indicated or in the case of third-party content lawfully used.

The user may consult and use the site content exclusively for personal, informational, and non-commercial purposes. Reproduction, copying, modification, distribution, communication to the public, systematic extraction, reuse, or economic exploitation of the content without the prior written consent of the Club or of the party holding the relevant rights is prohibited.

The use of the name Flamingo Surf Club, the logos, the images, and the other distinctive signs on the site is not permitted in the absence of authorization. Any unauthorized use may be prosecuted in the appropriate venues to protect the rights of the Club and of any third-party holders.

7. Links to third-party sites and platforms

The site may contain links to external platforms, social networks, messaging systems, maps, partner sites, or other services managed by third parties. Such links are provided to assist the user, but the Club exercises no control over the content, features, terms of use, privacy notices, or commercial practices of the third parties.

Access to external sites or services takes place under the responsibility of the user, who is invited to consult the conditions and notices made available by the respective operators. The presence of a link does not imply approval, guarantee, or assumption of responsibility by the Club with respect to the linked content or services.

8. Site availability and limitations of liability

The Club undertakes to keep the site accessible and functioning, within the limits of what is reasonably possible. However, it cannot guarantee that the site is always available or free from interruptions, errors, delays, malfunctions, vulnerabilities, viruses, or other harmful elements, also due to its dependence on hosting, connectivity, maintenance, software update, and third-party services.

The Club may suspend, limit, modify, or temporarily interrupt the site or individual features for technical, security, maintenance, update, regulatory, or organizational needs, without this entailing liability towards the user, except in cases of wilful misconduct or gross negligence and without prejudice to the mandatory rights recognized by law.

The information published on the site does not replace personalized assessments of the user’s physical condition, fitness for sports practice, or safety of the activities. The user is aware that the sports disciplines offered by the Club may involve risks physiologically connected to sports practice, the marine environment, the board, the wind, balance, falls, and interaction with other participants. The conditions of participation in the activities are governed by separate agreements, notices, and regulations.

9. Processing of personal data and cookies

The processing of users’ personal data is governed by the privacy policy published on the site, to which full reference is made. When filling out the forms, the user is invited to review the privacy notice before sending the data.

The site uses cookies and similar technologies as indicated in the consent management banner and in any cookie policy published on the site. The user can manage their preferences through the tools provided, it being understood that some technical cookies are necessary for the correct functioning of the site.

10. Changes to the terms of use

The Club reserves the right to modify these terms at any time, in order to adapt them to regulatory, technical, organizational, commercial, or functional changes to the site. Changes will be effective from the moment of their publication, unless otherwise indicated.

The user is invited to consult this page periodically. Use of the site after the publication of the changes constitutes acknowledgement of the updated version, it being understood that any contractual relationships already concluded will remain governed by the conditions applicable at the time of their conclusion, unless otherwise agreed between the parties or otherwise mandatorily provided by law.

11. Applicable law, jurisdiction, and consumer protection

These terms are governed by Italian law. For any dispute relating to the interpretation, validity, effectiveness, or execution of these terms, the court identified according to the applicable legal rules will have jurisdiction.

Should the user act as a consumer pursuant to the Consumer Code, the mandatory jurisdiction of the court of the consumer’s place of residence or domicile, if located within the territory of the State, remains, as well as any other mandatory protection provided for by the applicable legislation.

12. Acceptance of the terms

Browsing the site entails acceptance of these terms of use. Where the site requires specific acceptance by selecting a dedicated checkbox or other equivalent mechanism, the user must carefully read the document before proceeding with the sending of the request or the use of the relevant feature.

Pursuant to and for the purposes of Articles 1341 and 1342 of the Italian Civil Code, where applicable, the user specifically acknowledges the clauses relating to the informational nature of the site, the absence of automatic conclusion of contracts, user obligations, limitations of liability, site availability, third-party links, changes to the terms, applicable law, and jurisdiction.
